Do I have to get married in California to file a divorce in California
You can file a divorce in California even if you were married outside California or even outside USA. To file a divorce in California you or your spouse must have lived in:
- California for the last 6 months, and
- Any of the California county for the last 3 months
What if my Spouse is not In California or never been to California ?
It does not matter. As long as you are able to full the California residency requirement you can get the divorce in California.
Wait…. I am Muslim and I have divorce papers from the mosque here in California. Do I still need to go to court ?
Yes, you do. The religious divorce is not valid for the legal purposes. It may be good for the religious purposes. You need a order form the Court to have the valid divorce.
Hmm, my spouse does not live in USA – Now What ?
It is still the same. If you have lived in California for the last 6 months, and any of the California county for the last 3 months, it does not matter where your spouse lives.

However, if you tried your best but could not locate the spouse and have no idea about the location of your spouse, you can get the order form the court for publication/posting the summons to serve your papers.
